1. About us

Evolve Web Studios is a web design and development studio based in India, providing services to businesses in India and the United States. References to "we", "us" or "our" mean Evolve Web Studios. References to "you" or "client" mean the individual or business engaging our services.

2. Services

We provide web design, web development, website redesign, landing page creation and related digital services. The exact scope of work for each project is agreed upon before work begins, either through a written proposal, a WhatsApp conversation or an email exchange.

We reserve the right to decline any project at our discretion, including projects that conflict with our values or involve content we consider harmful, misleading or illegal.

3. Project scope & changes

The agreed scope covers the work described at the start of the project. Any additions or significant changes requested after work has begun may be treated as a separate scope of work and quoted accordingly.

Minor adjustments within the spirit of the original brief are included. We will always communicate clearly if a request falls outside the agreed scope before proceeding.

4. Payments

Our standard payment structure is:

• 50% deposit required before work begins
• Remaining 50% due before the final deliverable is handed over or the site goes live

Payment terms for individual projects may vary and will be confirmed in writing before work starts. We accept payments via bank transfer, UPI and other methods agreed upon per project.

Work will not commence until the deposit is received. Final files and live access will not be released until the balance is cleared.

5. Revisions

Each project includes a reasonable number of revision rounds as agreed at the start. Typically this means two rounds of revisions per major deliverable. Revisions beyond this may be charged at an hourly or fixed rate, which we will communicate in advance.

A revision means adjustments to existing work. A revision is not a redesign or a change in direction — those are treated as new scope.

6. Timelines & delays

We provide estimated timelines at the start of each project. These are good-faith estimates, not guarantees. Timelines depend on both parties — delays caused by late feedback, missing content or unresponsiveness from the client will extend the delivery date accordingly.

We will always communicate proactively if our side is causing a delay.

7. Client responsibilities

To allow us to deliver quality work on time, you agree to:

• Provide all required content, assets, credentials and information in a timely manner
• Give clear, consolidated feedback within agreed timeframes
• Ensure that any content, images or materials you provide do not infringe third-party rights
• Have the authority to commission the work on behalf of your business

8. Intellectual property & ownership

Upon receipt of full payment, you own the final website and all custom design and code created specifically for your project. We retain the right to display the work in our portfolio unless you request otherwise in writing.

We retain ownership of any reusable code libraries, frameworks, templates or tools we use that are not created exclusively for your project. Third-party assets (fonts, stock images, plugins) remain subject to their own licences.

Before full payment is received, all work remains the intellectual property of Evolve Web Studios.

9. Confidentiality

We treat all information you share with us — business details, strategies, financials, customer data — as confidential. We will not share it with third parties without your consent, except where required by law.

We ask that you treat any proprietary processes, pricing or materials we share with you with the same respect.

10. Cancellations & refunds

If you cancel a project after work has begun:

• The deposit is non-refundable
• If work completed exceeds the deposit value, you will be invoiced for the difference based on work done to date
• If work completed is less than the deposit value, we may issue a partial credit at our discretion

If we cancel a project on our side for any reason, we will refund any amount paid that exceeds the value of work completed.

11. Warranties & liability

We take care to deliver high-quality work, but we do not guarantee specific business outcomes such as increased traffic, leads or revenue from a website we build.

We are not liable for:

• Losses arising from third-party services (hosting, domain registrars, payment gateways)
• Downtime, data loss or security breaches on platforms we do not control
• Any indirect, consequential or incidental damages arising from the use of our work

Our total liability in any circumstance is limited to the amount paid by you for the specific project in question.

12. Third-party tools & platforms

Some projects may involve third-party platforms, plugins or services (e.g. hosting providers, CMS platforms, form tools). We are not responsible for changes, outages or pricing changes made by those third parties. Their own terms of service apply.

13. Post-launch support

Unless a support retainer is agreed, our responsibility ends once the final deliverable is handed over and payment is complete. We are happy to assist with post-launch updates and changes — these will be scoped and quoted separately.

14. Governing law

These terms are governed by the laws of India. Any disputes will first be attempted to be resolved amicably. If that is not possible, disputes will be subject to the jurisdiction of the courts of India.

For clients based in the United States, we will make reasonable efforts to resolve disputes informally before any formal proceedings.

15. Changes to these terms

We may update these terms from time to time. The version in effect at the time a project begins is the version that applies to that project. We will update the "Last updated" date at the top of this page when changes are made.
